By accessing and using Poolport ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Poolport is a platform that connects pool players with venues, facilitates table bookings, enables player connections, and supports club creation and management. The Service includes:

• Venue discovery and information
• Pool table booking system
• Player networking and connections
• Club creation and management
• Challenge creation and tracking
• Marketplace for pool equipment
• Event listings and RSVP functionality

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Age Requirement

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age.

4. User Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Harass, abuse, or harm other users
• Post false, misleading, or fraudulent information
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any portion of the Service
• Use automated systems to access the Service without permission
• Collect or harvest information about other users without their consent
• Post content that is offensive, defamatory, or violates others' rights

5. Bookings and Payments

5.1 Table Bookings

When you book a pool table through the Service, you enter into an agreement with the venue owner. Poolport acts as an intermediary platform and is not responsible for the actual provision of services by venues.

5.2 Payment Processing

Payments are processed through secure third-party payment processors. You agree to provide accurate payment information and authorize us to charge your payment method for all fees associated with your use of the Service.

5.3 Cancellations and Refunds

Cancellation and refund policies are determined by individual venues. Please review venue-specific policies before making a booking. Poolport is not responsible for refunds unless required by applicable law.

6. Marketplace

6.1 Marketplace Items

The marketplace feature allows users to buy and sell pool equipment. Poolport is not a party to transactions between buyers and sellers and is not responsible for the quality, safety, or legality of items listed.

6.2 Seller Responsibilities

Sellers are responsible for accurately describing items, setting prices, and completing transactions. Sellers must comply with all applicable laws and regulations.

6.3 Buyer Responsibilities

Buyers are responsible for reviewing item descriptions, asking questions, and making informed purchasing decisions. Buyers should exercise caution when transacting with other users.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Poolport and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of content you post on the Service. By posting content, you grant Poolport a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content for the purpose of operating and promoting the Service.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Poolport does not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POOLPORT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Indemnification

You agree to indemnify and hold harmless Poolport, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of South Africa.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
